By accessing our website and using our lead generation services, you agree to comply with and be bound by the following terms of use, which together with our privacy policy govern our relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

Definitions and Interpretation

The following terms have the following meanings:

“Lead Generation” means the process of identifying and cultivating potential customers for a business's products or services.

“Lead Generation Ad or Campaign” means an advertising unit allowing people to provide Lead Generation Data to you.

“Lead Generation Data” means any information a user voluntarily submits through a Lead Generation Ad.

“Payments” refer to the payment you make on our platform for the purpose of lead generation.

“Card Service Charge” (or) “Payment Gateway Charges” refer to the cost that is charged to facilitate online payment via the payment gateway.

Register as an Advertiser or Publisher

• 1.  We reserve the right to approve or disapprove your application to join us based on several eligibility criteria.

• 2.  By registering as an advertiser or publisher, you agree to our privacy policy and Terms of Use.

Lead Generation Terms (for Advertisers)

• 1.  By creating a lead generation Ad or Campaign, you agree to the following terms and conditions:

  • a.   You are fully responsible for the storage, security, and usage of Lead Generation Data that you receive through the Lead Generation Ad or Campaign.

  • b.   You are the Data Controller of the Lead Generation Data, and you agree to use it only for your company, which you advertise in the Lead Generation Ad or Campaign, and not to sell the Lead Generation Data to any third party.

  • c.   You agree not to use the Lead Generation Data for any unlawful purpose, including but not limited to, infringing on intellectual property rights, violating privacy rights, or engaging in fraudulent activities.

  • d.   You will further ensure that none of your Lead Generation Ad or Campaigns target individuals under the age of 18.

  • e.  Compliance: You must comply with all applicable laws and regulations related to lead generation in the countries where both you and the leads are located. This includes laws related to data privacy, anti-spam, and advertising.

    • i.   You undertake full responsibility to protect the personal information of the leads.

    • ii.   You agree to comply with data protection regulations, such as the General Data Protection Regulation (GDPR), the CAN-SPAM Act, the California Consumer Privacy Act (CCPA), all the FTC regulations, or any regulations governing data protection and privacy policy in the countries where both you and the leads are located.

    • iii.   If you breach the laws, you will be fully responsible for all consequences arising out of such a breach. (e.g., action by government agencies)

  • f.   Whenever any lead submits an opt-out form on our website, we will inform you through email. Upon receiving such an email, you should stop communicating with them further; failing which, you will be fully responsible for all consequences arising out of such a breach. (e.g., action by government agencies). You consent to comply with this point even after you discontinue using our website.

• 2.  The lead generation Data submitted by clients is set to expire within 30 days from the date of submission and will be deleted from our database automatically. You are responsible for downloading it periodically, connecting it to your Google Sheets or server, and saving it.

• 3.  Payment Terms:

  • a.   The payments that you make for Lead Generation on our platform work on a prepaid model.

  • b.   By using our Lead Generation Services, you authorize us to make deductions from your prepaid wallet and credit card on file towards the Lead Generation charges as follows:
              Everyday at 03:00 a.m. UTC,

    • i.   Lead Generation Costs spent from 3:00 a.m. yesterday until 3:00 a.m. today will be deducted from your prepaid wallet.

    • ii.  The next day's campaign budget minus your wallet balance will be charged to your card.

  • c.   On rare occasions, if our payment system fails to make deductions, we may charge the charges at any time of the day.

  • d.   You may also make manual payments to top up your prepaid wallet.

  • e.   While making deductions from your card, a card service charge will also be charged together with your payment, which varies from time to time and is mentioned in the payments page as well as in your invoices.

  • f.   Your unused wallet balance, minus any dues, will be refunded to your original payment method within 7 working days if you submit an account closure request via support ticket. Bonus credits will expire upon account closure and won't be refunded.

• 4.  By creating a lead generation campaign, you authorize Us to register any domain names or create any apps for the purpose of generating leads. Such domain names remain the property of Leads Paid Singapore Private Limited until their expiration. The copyright of the contents used on such websites or apps belongs to Leads Paid Singapore Private Limited At any point in time, you may request Us to stop using them (but not claim ownership) by contacting us.

• 5.  By creating a lead generation campaign, you authorize Leads Paid Singapore Private Limited to use the contents, images, banners, etc. from your website or social media (that you input while creating a campaign or sending us via other medium) in any manner (e.g., contents for use in banners, videos, other creatives, landing pages, or materials created by Us or by our AI for the purpose of generating leads for your campaign). At any point in time, you may request Us to stop using them (but not claim ownership) by contacting us.

Prohibited Use

You agree not to use our website for any unlawful purpose, including but not limited to infringing on intellectual property rights, violating privacy rights, or engaging in fraudulent activities. You also agree not to interfere with the functionality of our website or attempt to access our website in an unauthorized manner.

Limitation of Liability

We are not liable for any damages arising from your use of our website, including but not limited to direct, indirect, incidental, punitive, or consequential damages. We are also not responsible for any errors, omissions, or inaccuracies on our website.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our website, including but not limited to any violation of these Terms of Service.

Closing Your Account

You may close your account with us by submitting a support ticket. Upon such closure, you shall be refunded any unused amount in the prepaid wallet after deducting any uncharged balance due within 7 days from the date of submitting the support ticket.

Termination

We may terminate your access to our website at any time without notice if we believe you have violated these Terms of Service.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of California, USA. Any legal action arising from these Terms of Service shall be brought only in the courts of California, USA.

Changes to these Terms of Use

We reserve the right to modify these terms and conditions at any time without notice. You should check these terms and conditions periodically. By using this website after we post any changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them.
